Surplus purchase terms

Last updated 18 August 2026

These terms apply when you offer equipment to us through our Sell Your Surplus service. Here, you are the seller and we are the buyer.

How it works

  • You send us your list — brands, part numbers, quantities and condition, with photographs and serial numbers if you have them.
  • We make an offer, usually within one business day, stating the price, the currency, the condition we have assumed and how long the offer stays open.
  • You accept, and we agree the freight arrangements. We can often cover inbound freight — the offer will say so.
  • You ship it to us.
  • We inspect and test it on arrival.
  • We pay you.

Our offer

Our offer is based on what you have told us and on any photographs you send. Unless it says otherwise it is valid for 14 days, and it is subject to inspection and testing on arrival.

It is an offer to buy on these terms, and a contract is formed when you accept it in writing. Prices are in Australian dollars unless we agree otherwise.

What you promise us

  • That you own the equipment outright, or are authorised by the owner to sell it, and will provide evidence of that authority if we ask.
  • That the equipment is free of any security interest, lien, charge, mortgage, hire purchase, lease, retention of title or other encumbrance — or that you have told us about it and will procure a release before delivery. We may search the Personal Property Securities Register, and we will not complete a purchase while a registered security interest remains.
  • That the equipment is not stolen, and is not the subject of an insurance claim, a dispute, an investigation or a court order.
  • That your description — brands, part numbers, revisions, quantities, condition, functionality and completeness — is accurate and not misleading, and that you have told us about any known fault, damage, repair, modification or missing component.
  • That selling it to us does not breach any agreement you have with anyone else, including a manufacturer, distributor or lease agreement.
  • That the equipment is not subject to an export control or sanctions restriction that would prevent us buying or on-selling it.

Inspection, and what happens if it differs from your description

We inspect and test equipment on arrival. If it materially differs from your description — a different revision, missing modules, damage, an undisclosed fault or a lower quantity — we will contact you and offer you a revised price you may accept or decline, return of the equipment, or return of only the non-conforming items with payment for the rest.

Where the difference is our error we pay the return freight; where your description was materially wrong, you do.

We will not keep equipment at a reduced price without your agreement, and we will not dispose of equipment you have asked us to return.

Condition and honest description

We buy used equipment and we expect cosmetic wear. What matters is that your description is accurate. Tell us if a unit is untested, known faulty, missing accessories, water-damaged, previously repaired or modified — an honest description gets a firm offer and a fast settlement; an inaccurate one costs both of us time.

Freight, risk and title

  • Freight: we arrange and pay for inbound freight where our offer says so; otherwise you do.
  • Risk: the equipment is at your risk until we receive it at our premises — unless we arranged and paid for the freight, in which case it is at our risk from collection.
  • Title: passes to us on the later of our receipt of the equipment and our payment to you. You must not sell, encumber or dispose of the equipment to anyone else after accepting our offer.

Payment

We pay by bank transfer to the account you nominate once we have completed inspection, and we send you a remittance advice.

If you are registered for GST, tell us and give us your ABN so we can handle the invoicing correctly.

Erase your data before you ship

Before you send equipment, remove or erase everything you do not want us to have — programs, configurations, recipes, parameters, production data, network settings, credentials, memory cards and licence dongles.

We erase or reset user memory where it is practical to do so, but we cannot guarantee that all data is removed and you should not rely on us to do it.

Firmware and embedded software belongs to the manufacturer and is licensed, not sold. Selling us the hardware does not transfer any software licence. If any equipment carries a licence, dongle or activation you are contractually required to return to a manufacturer or lessor, tell us before you ship.

Cancelling

You may withdraw your acceptance at any time before you ship the equipment by telling us in writing. If we have already paid for freight, we may ask you to reimburse the actual cost.

We may cancel before payment if the equipment materially differs from your description and you decline our revised offer; if we discover a security interest, ownership dispute or other encumbrance; if we form a reasonable belief that the equipment is stolen or that we cannot lawfully buy it, in which case we may also be required to report it and to hold the equipment pending advice; or if buying or on-selling it would breach an export control or sanctions law.

Your indemnity

You indemnify us against loss, damage, cost and expense arising from a breach of the promises you make above — including a third-party claim to ownership of, or a security interest in, the equipment.

This indemnity does not apply to loss caused by us or by our own breach. If you are an individual selling personal property rather than a business selling surplus, it applies only to the extent it is fair and reasonable.

General

We handle your personal information in accordance with our Privacy Policy — for this service that includes your bank details, which we use only to pay you.

These terms are governed by the laws of Queensland, Australia. Our Terms & Conditions apply where relevant, and our complaints process applies to any dispute about a surplus purchase. Email [email protected] or call +61 422 735 541.
